Seems pretty clear to me that NIL should be covered under Title IX:

I think Title IX needs to be updated. It’s a fact that men’s sports, in general, generate more interest and money. As such, if athletes are going to be paid then male athletes on average deserve more pay.

I’m not a lawyer. NIL may be a murky area of this law based off of case law. Maybe this action is appropriate in the sense of being legal and within the norms of Presidential power.
